Terms and Conditions

§ 1 Scope

(1) These General Terms and Conditions (T&C) apply to all contracts concluded via the website purgifier.com ("PURGIFIER") between the provider (see Legal Notice) and the user.

(2) PURGIFIER provides an AI-powered text transformation service that converts generic-sounding text into more authentic language ("Exorcism").

(3) A consumer within the meaning of these T&C is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity (§ 13 BGB — German Civil Code).

§ 2 Contract Formation

(1) Registering an account does not constitute a binding offer. A contract for the use of paid features is only concluded upon completion of the checkout process with our payment service provider (Creem).

(2) Free features (heat levels 1–2, max. 250 words) may be used without a purchase contract. These T&C still apply.

§ 3 Service Description

(1) Blitz Pass (€4.99): 48-hour access to all heat levels (1–5), word cap of 1,000 per transformation, fair-use budget of 50,000 words, max. 30 requests/hour.

(2) Monthly Pro (€12/month): 30-day access to all heat levels, word cap of 1,000 per transformation, fair-use budget of 50,000 words, max. 100 requests/hour, voice presets, bulk upload (up to 10 texts). The subscription does not renew automatically. After 30 days, access ends without additional charges and without requiring cancellation.

(3) Refill (€4.99): One-time top-up of the fair-use budget by 50,000 words. Available only for users with an active Pro subscription.

(4) Text transformation is performed using AI models (see AI Transparency). The provider does not guarantee any particular quality of results, as outcomes depend on input quality and the selected heat level.

§ 4 Prices and Payment Terms

(1) All prices are in euros and include the applicable statutory value-added tax. VAT is remitted by Creem as the EU Merchant of Record.

(2) Payment processing is handled by Creem. The provider has no access to your payment details (credit card, PayPal, etc.).

§ 5 Right of Withdrawal and Digital Content Clause

Special notices regarding the 48h Blitz Pass and Refill:

(1) The purchase of a Blitz Pass or Refill constitutes the provision of digital content that is not supplied on a tangible medium.

(2) Pursuant to § 356(5) BGB, your right of withdrawal expires once the provider has begun to perform the contract — that is, as soon as you carry out the first text transformation ("Exorcism") after activation.

(3) Before completing the purchase, you expressly agree:

"By purchasing, I agree that the service begins immediately, and I confirm that I lose my 14-day right of withdrawal once the service has been fully provided."

(4) For the Monthly Pro subscription, the standard 14-day right of withdrawal from the date of contract formation applies, provided no service has been used during this period. After first use, the right of withdrawal expires accordingly.

§ 6 Cancellation Instructions

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract was concluded.

To exercise your right of withdrawal, you must inform us — ···, ···, ··· ···, Email: ··· — by means of a clear statement (e.g. email or letter) of your decision to withdraw from this contract. You may use the model withdrawal form in § 7, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal. We shall use the same means of payment you used for the original transaction for this reimbursement.

Expiry of the right of withdrawal for digital content

The right of withdrawal expires pursuant to § 356(5) BGB if you have expressly agreed that the provider may begin performance before the expiry of the withdrawal period and you have confirmed that you lose your right of withdrawal upon commencement of performance (see § 5 of these T&C).

§ 7 Model Withdrawal Form

§ 8 Limitation of Liability

(1) The provider is liable without limitation for intent and gross negligence.

(2) For slight negligence, the provider is only liable in the event of a breach of material contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, typically occurring damage.

(3) Liability for damages arising from injury to life, body, or health, as well as liability under the Product Liability Act, remains unaffected.

(4) The provider assumes no liability for the accuracy, completeness, or quality of text results generated by AI models. The user is responsible for reviewing and using the results.

§ 9 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes shall be the registered office of the provider.

(3) Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall not be affected (severability clause).
